Bushhog Accident Results in Amputated Foot – $300,000 Settlement

$300,000 settlement Mr. Neal’s client was picking peaches on a farm in rural Edgefield County, SC when a bush hog operator failed to warn him to get out of the way and negligently ran over his foot, seriously cutting up his foot and requiring a lower leg amputation. The farmer had only $300,000 in liability insurance. This case settled for the insurance policy limits shortly after suit was filed by Mr. Neal in the Aiken County Court of Common Pleas. The farmer did not have sufficient assets to pay a judgement in excess of his insurance policy limits and the bush hog driver claimed that he told the victim to get out of the way and the victim ignored him.
